This Privacy Notice describes Arris Software, Inc., a Delaware corporation’s (“Arris”, “we”, “us,” or “our”), practices with respect to your personal information, including the types of information Arris collects, how Arris uses and shares that information, and your choices.  Cinergy is a product of Arris.

This Privacy Notice covers information collected through:

  • our public-facing site that links to this Privacy Notice (“Site”);
  • our online applications, services, and tools, and any other of our content, that can be ordered from us through the Site or otherwise (“Services”);
  • demonstrations of our Services and similar activities (“Demonstrations”); and
  • our customers (e.g., account holders for our Services, such as freelancers, studios and production companies) and third parties (e.g., production directories and professional associations).

By using the Site or Services, or by attending a Demonstration, you agree to the terms of this Privacy Notice.

Collection of Information

Arris collects information, including personal information (1) directly from you when you provide it to us; (2) automatically when you interact with our Site or Services; (3) from our customers; and (4) from third parties.

Information you provide to us directly may include:

  • Contact information, such as name, email address, postal address, and telephone number;
  • Credentials, such as a username and password;
  • Credit card, bank account, or other payment information;
  • Union, guild or other professional affiliation;
  • Department and job title; and
  • Correspondence and other information that you send to us.

Information we collect automatically may include:

  • Log files reflecting your IP address, browser type, internet service provider, referring and exit web pages, operating system and date/time stamp, and other data reflecting your actions and activities on our Site and through our Services;
  • Location data;
  • Information collected through cookies, web beacons, pixel tags, and other similar technologies; and
  • Records of purchases made through our Site.

Information we collect from customers and third parties may include:

  • Contact information, such as name, email address, postal address, and telephone number;
  • Credentials, such as a username and password;
  • Credit card, bank account, or other payment information;
  • Union, guild or other professional affiliation; and
  • Department and job title.

Use of Information

We use the information, including personal information, collected through our Site, Services or Demonstrations to:

  • Provide and improve our Site, Services and Demonstrations;
  • Understand how you interact with our Site and Services;
  • Register or authenticate users for our Services;
  • Communicate with you about our Site, Services or Demonstrations;
  • Perform analytics;
  • Prevent and detect fraud and misuse;
  • Comply with legal requirements;
  • Provide customer service support or respond to your inquiries;
  • Conduct surveys;
  • Generate leads;
  • Conduct investigations regarding violations of our policies or other legal rights, in accordance with applicable law; and
  • Perform other functions requested by you or our customers.

We may use personal information to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or the instructions provided in any email we send.

Information Sharing and Disclosures

We may share personal information with our customers with which you collaborate and third-party service providers for purposes of providing the Site, Services and Demonstrations. We require third-party service providers to comply with this Privacy Notice or be bound by confidentiality or data protection agreements that offer similar protections. We do not sell personal information to third parties. 

We may also share your personal information if required to do so by law, to enforce our Website Terms of Use or Terms of Service, or in urgent circumstances to protect personal safety, the public, or our Site or Services. In addition, we may share your personal information when we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to: (1) detect, prevent or otherwise address fraud, security, or technical issues; (2) protect against harm to the rights, property, or safety of Arris, its users, or the public; or (3) if Arris is involved in a merger, acquisition, or sale of all or a portion of its assets requiring the transfer of personal information.

Third Party Applications and Sites

Arris may make third party applications available through our Site and Services. Collection of information by a third-party application is governed by the privacy policy of the third-party application provider.

The Site may contain links to other sites. Arris does not share your personal information with those sites and is not responsible for their privacy practices. If you submit personal information to any of those sites, your information is governed by their privacy policies.

The Site may include social media features and widgets. Your interactions with these features are governed by the privacy policies of the companies providing them.

Arris uses Stripe, Inc. (“Stripe”) to process credit card payments made to us. In connection with the processing of such payments, we do not retain any personal or financial information such as credit card numbers. Rather, all such information is provided to Stripe as our third-party processor. If you use a credit card to pay for our Services on our Site, the credit card payment processing services are provided by Stripe and are subject to the Stripe Terms of Service and the Stripe Privacy Policy (collectively, the “Stripe Services Agreement”). By using the credit card processing services, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition to our enabling credit card payment processing services through Stripe, you agree to provide us accurate and complete information about you, and you authorize us to share any such information with Stripe, as well as transaction information related to your use of the payment processing services provided by Stripe. If you are providing credit card payment information on behalf of a customer, you agree you have the authorization of the customer to provide such information.  We are not responsible for the performance of any third-party credit card processing or third-party payment services.

Data Security

We use commercially reasonable technical, organizational and administrative measures to protect our Site and Services against unauthorized or unlawful access and against accidental loss, theft, disclosure, copying, modification, and destruction, or damage. Nonetheless, we cannot guarantee that transmissions of your information will always be secure or that unauthorized third parties will never be able to defeat the security measures taken by us or our service providers. You play an important role in keeping your information secure. You should not share your username, password, or other Services account information with anyone. If you believe that the security of our Site or Services have been compromised, please contact us immediately as detailed in the “Contact Us” section, below.

Children

Our Site and Services do not target and are not intended to attract children under the age of 13. Arris does not knowingly collect personal information from children under the age of 13 without parental consent. If you believe a child has provided information through our Site or Services without parental consent, please contact us immediately as detailed in the “Contact Us” section, below, so that we can delete his or her information.

Cookies

Some parts of our Site and Services may use cookies to personalize your experience, to track user traffic patterns to determine the usefulness of the information on our Site and in our Services to our users, and to see how effective our navigational structure is in helping users reach that information.

If you prefer not to receive cookies while browsing our Site or using our Services, you can set your browser to warn you before accepting cookies and refuse cookies when your browser alerts you to their presence. You can also refuse all cookies by turning them off in your browser, although you may not be able to take full advantage of our Site or Services if you do so. To the extent required by applicable law, we provide you with the ability to access, correct, export, erase, restrict or limit our use of, withdraw consent to or object to the processing of, or request us to suspend the processing of, your personal information. Consent to Transfer

Your information, including personal information, may be transferred to and stored on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. Please note that we transfer data, including personal data, to the United States and Canada and store and process it there. Your consent to this Privacy Notice followed by your submission of such information represents your agreement to such transfer.

Changes

We may, at our discretion, change, modify, or remove portions of this Privacy Notice at any time without notice to you, except, if you have provided an email address, we will notify you of any material changes to the way in which we process your personal information. We suggest that you check this Privacy Notice periodically for changes. Your use of the Site and Services indicates your full acceptance of this Privacy Notice in its entirety every time you use the Site or Services. If you use the Site or Services after we post changes to this Privacy Notice, you accept the changed terms.
